Paguro AS (the "Service Provider") owns and operates the website paguro.no (the "Service") under the domain (….). The service provider offers a platform for renting out business premises (the "Rental Object") on behalf of legal persons with available business premises ("Landlord") to legal persons in need of business premises ("Tenant"). The purpose of the service is to prevent premises from being unused, by offering the Tenant and Landlord a platform where short-term rental of premises can be carried out in an innovative and flexible way. The terms of use are considered accepted when using paguro.no.
RENTAL TERMS OF USE (TERMS OF USE)
1. QUALIFICATION REQUIREMENTS
Landlord who uses paguro.no, must meet the following conditions:
Be organized as a company, cooperative, association, foundation, mutual fund or sole proprietorship.
Hold a Norwegian organization number registered in the Register of Legal Entities Even if the Landlord satisfies the above conditions, the Service Provider is free to refuse the Landlord to use paguro.no, without further justification.
If the Landlord uses paguro.no without fulfilling the conditions set out in this section 1a, the Service Provider may immediately terminate the Landlord's user account.
2. REGISTRATION AS A LESSOR
By creating a user account with the Service Provider, the Landlord undertakes to provide information that is correct, accurate and complete, and to keep this information up to date at all times. Violation of this point will constitute a significant breach of contract which could result in the Service Provider closing the Landlord's user account, in addition to canceling agreements entered into for rent, without the Landlord being reimbursed for loss of rent.
3. USER CONTENT
All information transferred from the Landlord to the Service Provider may be displayed publicly, used, modified, reproduced, and distributed on paguro.no, and websites belonging to the Service Provider's partners, including marketing and distribution channels. This right also applies after the contractual relationship between Service Providers and Landlord has ended.
The Landlord confirms that all content shared with the Service Provider, or that appears on pgauro.no does not infringe the rights of a third party. This includes copyrights for images, text, illustrations and other material. The Service Provider does not review all content shared with the Service Provider, and the Landlord therefore has full responsibility and guarantees that all content shared is correct, appropriate, legal, and does not infringe the rights of any third party. If a third party claims that the content shared with the Service Provider or uploaded on paguro.no is in violation of his / her rights, the Landlord is liable for any loss that the Service Provider may suffer as a result of the claim from a third party.
4. RIGHTS OF SERVICE PROVIDERS
The Service Provider's name and characteristics, trademarks, services, content, functions and functionality, and all other intellectual property rights developed in, or used by the Service Provider or paguro.no, belong to the Service Provider. The Landlord shall not copy, distribute, display, publish or sell information, software, products or services that belong to the Service Provider or that are made available on paguro.no.
5. TERMINATION OF USER ACCOUNT AND CHANGES TO USER TERMS AND SERVICES
The Service Provider may at any time, without further justification or notice, terminate or suspend the Landlord's user account.
6. LIMITATION OF LIABILITY
The services and information made available on paguro.no are offered "as is" without any guarantees. The Service Provider and its affiliates may not under any circumstances be held liable for damage to property, loss of data, lost profits or any other loss or cost that may arise in connection with the use of the Service, as a result of non-delivery of the Service.
7. CHANGES TO THE TERMS OF USE
The Service Provider may at any time, and without further justification or notice, change these terms of use, or discontinue or change the services that the Service Provider offers. The terms of use apply as they appear at any time on paguro.no, and the Landlord agrees to be bound by the updated version of the terms and conditions available on paguro.no at any time. The Landlord accepts that the Service Provider may change the terms of use without further justification or notice. The landlord will nevertheless normally be notified of changes of a significant nature, no later than one month before these take effect. By continuing to use paguro.no after the changes have taken effect, the Landlord is considered bound by the updated terms.
